Ninth Circuit Court rules that Second Amendment is “not a second class right”

Some additional good news on the gun rights front comes to us from an unexpected location this week… California. The Ninth Circuit Court was asked to rule on a “zoning ordinance” in Alameda County which would have placed severe restrictions on the opening of any new gun shop if it was within 500 feet of a wide variety of other types of structures.

Supreme Court knocks down SJC’s stun-gun ruling

The Supreme Court has zapped a decision by the Bay State’s highest court that found the Second Amendment does not apply to stun guns. The nation’s highest court ruled that the Massachusetts Supreme Judicial Court’s reasoning for allowing a ban of stun guns ran afoul of a 2008 decision by the late Justice Antonin Scalia that guaranteed an individual’s right to possess a firearm for traditionally lawful purposes.

Obama's Insidious Assault on Guns Continues

The sudden death earlier this month of Supreme Court Justice Antonin Scalia, who was an unapologetic supporter of firearms rights, has thrust the 2nd Amendment into the forefront of the burgeoning debate over who might replace him on the Supreme Court. While this is indeed a topic worthy of robust debate, what often is overlooked in such public discussions of the 2nd Amendment, are the many ways this Administration has chipped away at the Amendment outside the scrutiny of the courts.

People Have A 'Fundamental Right' To Own Assault Weapons, Court Rules

In a major victory for gun rights advocates, a federal appeals court on Thursday sided with a broad coalition of gun owners, businesses and organizations that challenged the constitutionality of a Maryland ban on assault weapons and other laws aimed at curbing gun violence. A three-judge panel of the U.S. Court of Appeals for the 4th Circuit said the state's prohibition on what the court called "the vast majority of semi-automatic rifles commonly kept by several million American citizens" amounted to a violation of their rights under the Constitution.

In the wake of the San Bernardino attack, liberals are in a total panic over guns. The New York Times broke a 95-year precedent to editorialize about gun control on its front page. Oregon Republican Party Supports Second Amendment, Opposes Senate Bill 941

Wilsonville, OR – The Oregon Republican Party strongly opposes Senate Bill 941, legislation that would require the registration of private gun sales, enforced through excessive penalties, including heavy fines and mandatory jail time. The Platform of the Oregon Republican Party clearly states:
    “we demand the protection of individual rights, freedoms and private property by local, state and federal government…” (Section 11)

Wisconsin's Sheriff responds to changes former Justice Stevens would make to the Second Amendment

INDIANAPOLIS — Sheriff David Clarke Jr. may not be a household name…yet. But he’s well on his way after his rousing speech at the 2014 NRA convention. Consider the standing ovation he received after revealing the seven words he would add to the Second Amendment: “Keep your hands off our guns, dammit.”

Clarke, the outspoken gun proponent who heads the sheriff’s office in Milwaukee County, Wisconsin, was easily one of the most popular speakers during the convention’s leadership forum. His comments about amending the Constitution were aimed at former Supreme Court Justice John Paul Stevens, who said in his recent book that he would change the Second Amendment by adding five words in the middle: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms when serving in the militia shall not be infringed.”

The Three Most Important Ongoing Second Amendment Cases

Addressing who can own guns, where they can carry them, and whether guns can be transported to a second home. Since the 2010 Supreme Court case McDonald v. Chicago, which applied the ruling in the 2008 Heller case (which said the Second Amendment guarantees an individual right to bear arms) to states and localities, the Court has so far evaded any new case about the limits and meaning of the Second Amendment. Those two cases, though, did not resolve all the important questions about how and when and why the government can restrict Second Amendment rights. Heller and McDonald said that the right to possess commonly used weapons for self-defense in the home cannot be infringed, but Justice Antonin Scalia in his majority opinion in Heller explicitly said this didn’t mean anything goes when it comes to Americans and their guns.

Senate Votes to Stop US From Joining UN Arms Trade Treaty

Patriot Update - In the last batch of amendment votes to the budget, the Senate voted on several foreign policy proposals. ✧ Sen. James Inhofe (R-Okla.) introduced an amendment that would prevent the United States from entering into the United Nations Arms Trade Treaty in order to uphold the Second Amendment. His amendment passed on a 53-46 vote. ✧ Republicans have been critical of President Obama’s decision to consider the treaty, although Obama has said he would not vote for anything that would violate the Second Amendment. ✧ The U.N. Arms Trade Treaty would regulate international arms sales. Negotiations end on March 28.

Communist Party USA Cheers Obama’s Gun Grab

NRO: What Closing the Gun-Show Loophole Won’t Do

National Review, 1/16/2013 (Hat tip: J. Sinclair and John H. Detweiler) - Author, Clayton E. Cramer claims that, "It is an article of faith that closing the “gun-show loophole” would make America a safer place." He adds, "This might seem surprising, and at first glance, it is. Except for one little detail: Criminals appear not to buy guns at gun shows, because guns are expensive. It is so much cheaper to steal guns instead." Russian News Outlet Pravda Prints Surprising Opinion Column Warning USA: ‘Never Give Up Your Guns’

Back in November, the Russian news outlet Pravda (formerly the official press of the USSR), surprised everyone when it published a scathing opinion column labeling President Obama a “Communist without question promoting the Communist Manifesto without calling it so.”
And they appear to have done it again, this time weighing on in the gun control debate currently gripping the United States.
Written by Stanislav Mishin, the opinion piece, titled “Americans, never give up your guns,” begins:
These days, there are few few things to admire about the socialist, bankrupt and culturally degenerating USA, but at least so far, one thing remains: the right to bare arms and use deadly force to defend one’s self and possessions.

Urge Your Senators to Oppose Kagen's Supreme Court Confirmation

NRA (Via email), 8/1/2010 - "The nomination of Elena Kagan to the U.S. Supreme Court will be decided next week, when the Senate casts the final vote on her confirmation. ∴ The NRA has announced our strong opposition to Ms. Kagan, due to her long record of antagonism toward the Second Amendment. Supreme Court affirms fundamental right to bear arms

WASHINGTON POST, 06/29/2010 by Robert Barnes and Dan Eggen - The Second Amendment provides Americans a fundamental right to bear arms that cannot be violated by state and local governments, the Supreme Court ruled Monday in a long-sought victory for gun rights advocates. ∴ The 5 to 4 decision does not strike down any gun-control laws, nor does it elaborate on what kind of laws would offend the Constitution. One justice predicted that an "avalanche" of lawsuits would be filed across the country asking federal judges to define the boundaries of gun ownership and government regulation. ∴ But Justice Samuel A. Alito Jr., who wrote the opinion for the court's dominant conservatives, said: "It is clear that the Framers . . . counted the right to keep and bear arms among those fundamental rights necessary to our system of ordered liberty." Hey everyone,
Second Amendment Week is off to a good start; we have sold a bunch of raffle tickets, hosted Chris Dudley on campus, been promoted on Lars Larson's show, and just today a lovely article was written about our event by Ben Price in the Barometer (thanks for the publicity)! ∴ Anyways, this is just a reminder that tomorrow at 6pm in Milam Auditorium we will be hosting a FREE for students Concealed Handgun License class / gun safety course. Make sure you bring your friends - I am looking to break last year's state-wide record of 175 attendees at a single CHL class. ∴ Also, don't forget to join the raffle. We are selling tickets all week out in the quad. If you don't want the gun, your dad might for fathers day or something! You will be competing against Chris Dudley, who we got to buy some tickets today!

Take action to protect 2nd Amendment Rights

Action Item: NRA-ILA GRASSROOTS ALERT - Ask Your U.S. Senators and Representatives to Sign Amicus Brief Supporting Second Amendment Rights in the States!

As a critical Second Amendment case goes before the United States Supreme Court, U.S. Senators Kay Bailey Hutchison (R-TX) and Jon Tester (D-MT), and Congressmen Mike Ross (D-AR) and Mark Souder (R-IN) are gathering signatures for an amicus curiae ("friend of the court") brief by Members of Congress. And we need your support for this important effort next week.

The case is McDonald v. City of Chicago, and it will answer the question of whether the Second Amendment applies to the states-as the Congress clearly intended in the 1860s, when it adopted the Fourteenth Amendment to protect constitutional rights against abuse by state and local governments.
