In the wake of the horrific terror attacks in San Bernardino and Paris, the FBI said it lacks the funds to stay ahead of the escalating terror threats right here in America. So why would we want to divert any of our tax dollars, which should be directed to reinforcing our nation’s security and intelligence apparatus to protect our families and our nation, to opening the gates to refugees from terror-supporting nations whom we CAN NOT vet and whose ranks ISIS and other terror organizations target to infiltrate?

URGENT Obamacare Update – ACTION NEEDED NOW!

- Senator Reid Thursday evening filed cloture on the House version of the DREAM Act (H.R.5281) and immediately announced that he would bring the bill up for a vote Saturday--most likely Saturday morning. If the Senate passes the DREAM Act, it will go straight to the President’s desk and become law. We therefore have about 36 hours to make sure all 100 Senators know that the American people overwhelmingly reject the DREAM Act!

ALERT: S-510 Food Takeover Act, S-787 Water Takeover Act
FREE REPUBLIC (Hat tip: Linda Weimer) - "Congress will convene November 15 to try to force into law all the things they didn't get done during the regular session. No one knows for sure just which bills will be on Nancy and Harry's agenda. It's Harry's agenda that is most important because the Senate - with 60 votes required to stop debate - offers the best opportunity to stop a bill.
S-510 - Food Safety Modernization Act - is one of the bills that must be stopped. Doreen Hannes has been following this bill for several organizations during its entire existence. Here's some of her reasons why the bill must be stopped. Doreen says:
"In a nutshell, S510 is effectively NAIS (National Animal Identification System) for everything. It is a tremendous amount of additional enforcement (fines and penalties, license revocations, further license requirements, control over processes and harvest) which are definite issues with the bill as it currently exists. However, not unlike the "Health Care" bill, they will have to pass this to see what it actually does.
"Here's why....In S 510, the FDA is instructed to follow all international agreements. One of the issues with international 'guidelines and standards' is "Good Agricultural Practices". Well those are not necessarily good. Most GAP certifying bodies have checklists about 25 pages long for growers to follow. They all require traceability (i.e., NAIS) they also require auditing, verifying and certifying the processes used to produce a consumable product for human or animal feed. Every step in GAP costs the grower of food money and a good deal of paperwork. What happens if you're better at growing food than filing forms? You will be penalized (i.e., more money). Sec 420 is exceptionally dangerous in my eyes. It subjects all farms that 'produce' milk to risk assessment and management (i.e., insurance).
"The idea that exemptions will be helpful is rose-colored-glasses thinking. Exemptions can easily be taken away or modified without Congressional oversight through the regulatory process. Most farmers aren't watching the Federal Register like hawks.
"The FDA has plenty of authority to protect the anonymous food supply already. But they don't. Instead, they put small entities out of business through Hazard Analasis & Critical Control Points (HACCP), also to be expanded in this bill, and heavier regulations that are not helpful to smaller economies of scale. The FDA inspects less than 1% of imported produce, has performed inspections on less than 25% of processing failties[sic] [facilities] that they are authorized to inspect (in a five year period) and they ALREADY have authority over live food animals on the farm. The USDA authority is over animal disease."
S-787 - Clean Water Restoration Act - will give the federal government jurisdiction over all water, everywhere, as well as jurisdiction over all activity that affects water wherever it may be. This would give to the federal government effective control over every square inch of land in the United States. It too, must be stopped. (see video 3:30)"

Call Oregon's U.S. Senators [ASAP] - "Please Vote NO on HR 3590"
OREGON REPUBLICAN PARTY, 12/22/2009 from Bob Tiernan, Chairman - Oregon Republicans: The United States Senate is scheduled to hold a series of votes over the next three days on health care reform. In the rush to pass their massive health care reform bill before Christmas, Senate Democrats have inserted a last-minute provision into the bill which overtly targets the construction industry by mandating all construction companies over 5 employees offer health insurance. However, every other industry is granted an exemption if they have fewer than 50 employees. Clearly, this is payback for the unions and a potentially devastating issue for many small construction companies in Oregon and across the country.
Who is the Senator that introduced this outrageous last-minute provision? None other than Oregon's own Jeff Merkley.
Senator Merkley inserted this provision into the health care bill as a "manager's amendment" with no open debate on the concept, no vote taken and certainly no Senate hearings proceeding it. There is no logical rationale for singling out the construction industry to suddenly have to offer health care plans if they have five or more employees. If there was a logical reason for it, they would have openly discussed this issue and cast a fair vote on it. This narrow provision is an unprecedented assault on small construction employers and unjustly targets an industry trying to keep its doors open during the worst housing downturn since the Great Depression.
We're asking you to take a few minutes today to call the offices of Senator Jeff Merkley and Senator Ron Wyden to express your outrage with this provision targeting small construction employers and ask them to "Vote NO on HR 3590" (the health care reform bill).

From Jean Nelson: OUR IMMEDIATE ACTION IS NECESSARY! This Wednesday morning Dec 9, Sen. Jeff Merkley will vote on the nomination of Chai Feldblum, a highly controversial figure, to serve as a Commissioner on the Equal Employment Opportunity Commission (EEOC). ∴ According to Feldblum, a person’s religious beliefs (what she calls “belief liberty”) can be trumped by “sexual liberty.” When the constitutionally guaranteed right to the free exercise of religion and “sexual liberty” conflict, Feldblum has stated: “I’m having a hard time coming up with any case in which religious liberty should win.” ∴ Feldblum ignores the fact that our Founding Fathers came to America to practice religious freedom, not just “believe” it. The First Amendment in the Constitution was created to guarantee and protect this right to practice religious belief. ∴ Urge Sen. Jeff Merkley to vote NO on the Feldblum nomination.
Through her writings and speeches, Feldblum has expressed support for polyamory – sexual and non-sexual relationships among multiple partners – both male and female. She wants the government to treat these “relationships” the same as one man/one woman marriage.

Call your Senators on WEDNESDAY
AMERICAN CONSERVATIVE UNION (Via email/hat tip: Pat Wills) - Call Sen. Ron Wyden (202) 224-5244 and Sen. Jeff Merkley (202) 224-3753 urge a 'NO' vote on the Motion to Proceed on Obamacare. ∴ Although Senate Majority Leader Harry Reid has refused to allow you or even his fellow Senators to see his version of the health care bill, he has vowed to force the Senate to take it's first vote before the Thanksgiving recess. ∴ That vote will be on a Motion to Proceed on the bill. THIS MOTION REQUIRES 60 VOTES AND IF IT FAILS OBAMACARE IS DEAD IN THE SENATE. Under Senate rules, the earliest this vote can take place is Friday. Reid has even threatened to keep the Senate in over the weekend and into Thanksgiving week until he has the votes he needs. Now is the time to act. We are asking every opponent of government-run health care to call their Senators on WEDNESDAY and ask them to vote "NO" on the Motion to Proceed.

Here's the Liberal strategy to pass this bill: to get the 60 votes to move to the bill, Reid has instructed Democrats to say that this first vote is a procedural vote - but in reality its passage would give Reid the power to cut backroom deals - much more than just procedure.
If this Motion to Proceed on Obamacare passes then Reid will cut backroom deals and add amendments to the bill until he gets the votes to pass Obamacare completely through the Senate. Then when the bill is merged with the House-passed bill, they can change the bill yet again.
Just a few weeks ago, 13 Democrats revolted against a bill to add $250 billion to the deficit by eliminating a reduction in physician reimbursement in Medicare without paying for it. They defeated the bill by voting against the Motion to Proceed. For these same Senators to now say this is not the most important vote is the height of hypocrisy.
The time to act is now! You must contact your Senators and let them know a vote on the Motion to Proceed is a vote in favor of the government takeover of our health-care system.

Even though as of Tuesday afternoon, Reid has not released the text of the bill, we know it will include a government-run health plan, increased taxes, cuts in Medicare and nothing to reduce ever-increasing health care costs. In fact, the Center for Medicare Services run by the Obama administration now says the Midnight bill passed by the House on November 7 will indeed cut benefits and raise premiums. It's no wonder Reid is hiding his version of the bill until the last minute.
Even if Reid gets his way and gets every one of the 60 Democrats to vote for the Motion to Proceed, we will join the battle over amendments and against a second cloture vote to cut off debate. All this will be unnecessary if we can stop the bill now.

Here's the Liberal strategy to pass this bill: to get the 60 votes to move to the bill, Reid has instructed Democrats to say that this first vote is a procedural vote - but in reality its passage would give Reid the power to cut backroom deals - much more than just procedure.
If this Motion to Proceed on Obamacare passes then Reid will cut backroom deals and add amendments to the bill until he gets the votes to pass Obamacare completely through the Senate. Then when the bill is merged with the House-passed bill, they can change the bill yet again.
Just a few weeks ago, 13 Democrats revolted against a bill to add $250 billion to the deficit by eliminating a reduction in physician reimbursement in Medicare without paying for it. They defeated the bill by voting against the Motion to Proceed. For these same Senators to now say this is not the most important vote is the height of hypocrisy.
The time to act is now! You must contact your Senators and let them know a vote on the Motion to Proceed is a vote in favor of the government takeover of our health-care system.

Tell your Senators to oppose cloture on Judge Hamilton
Action Item: Senator Jeff Sessions is calling on his colleagues to filibuster Judge David Hamilton. Tell your Senator to oppose cloture on David Hamilton and filibuster his nomination to the 7th Circuit Court of Appeals.
- Judge Hamilton, a district court judge, is Barack Obama's nominee to the 7th Circuit Court of Appeals. That very court has cited Judge Hamilton for abusing his power as a judge.
- In 1994, the 7th Circuit rebuked Judge Hamilton for denying a Rabbi the right to display a Menorah as part of an Indianapolis holiday display.
- In 2005, Judge Hamilton prohibited the Indiana House of Representatives from praying if Jesus's name was mentioned, but said praying in Allah's name was perfectly fine.
- He also is one of the most lenient judges in America when it comes to crime and criminals.
- In United States v. Rinehart, 2007 U.S. LEXIS 19498 (S.D. Ind. Feb 2, 2007), Judge Hamilton used his opinion to request clemency for a police officer who pled guilty to two counts of child pornography. The 32 year old officer had engaged in "consensual" sex with two teenagers and videotaped his activities.
- In United States v. Woolsey, 535 F.3d 540 (7th Cir. 2008), the Seventh Circuit faulted Judge Hamilton for disregarding an earlier conviction in order to avoid imposing a life sentence on a repeat offender.

Action Item: Oppose Clean Water Restoration Act (S 787)
OREGONIANS IN ACTION: The United States Senate is considering adoption of S 787, also known as the Clean Water Restoration Act, an innocent sounding name for a bill that would have significant impacts on all private property owners across the United States.
If approved, S 787 would amend the Clean Water Act by extending the authority of the Army Corps of Engineers and the Environmental Protection Agency, the two federal agencies charged with enforcing the Act.
Currently, the CWA regulates point source pollution discharges into "waters of the United States." The United States Supreme Court has interpreted the phrase "waters of the United States" to exclude isolated waters, such as ponds, intermittent streams, and wetlands which do not have a "significant nexus" to a navigable waterway. These bodies of water are not regulated by the CWA.
S 787 would change the CWA to significantly broaden the scope of the bill. If S 787 passes, it is hard to conceive of any kind of surface water source that would not be considered a "water of the United States." This could potentially mean that all land use activities near any type of surface water would require a federal permit. It could also be far less draconian than that. But the possibility of the federal control which S 787 could create makes it a very dangerous bill, and one that every property owner, as well as every state and local government that wants to retain control over land use matters in their jurisdiction, should oppose.
This is not the kind of legislation that will help Oregon property owners or Oregon's economy. The bill is scheduled for a vote in the Senate Environment and Public Works Committee this Thursday, despite the fact that the Committee has not held one hearing on the bill. Senator Jeff Merkley is on the Senate Environment and Public Works Committee.
Please call Senator Merkley's office and tell them that you oppose S 787 and that the federal government has no business regulating land use. That is an area for state, and preferably local, control. Demand that Senator Merkley call for hearings on S 787, and that he work closely with industry and property owners to understand that impacts that S 787 could have on small businesses and property owners.
